Terms of Service

Important Notice: FoodHandi is a food discovery and meal tracking application. It is NOT a medical device, nutritionist service, dietitian, or doctor. FoodHandi does not provide medical, nutritional, or dietary advice for any health condition. Nutritional information displayed is sourced from public databases and is approximate. If you have any medical condition, pregnancy, allergy, medication concern, or health question, consult a qualified medical professional. FoodHandi is for general wellness information only.

By using FoodHandi, you acknowledge that you have read, understood, and agreed to this notice.

1. Agreement Between You and Us

This Agreement ("Terms of Service" or "Terms") is a legally binding contract between:

These Terms govern your access to and use of the FoodHandi mobile application (the "App"), website (if any), and all related features, content, and services (collectively, the "Services").

By downloading, installing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Each individual is permitted one account. Sharing accounts is not permitted and may result in account termination.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Services for your personal, non-commercial use.

When you delete your account, your User Content is permanently removed from our active systems within 30 days, except where retention is required by law.

6. Subscriptions and Payments

6.1 Free and paid tiers

FoodHandi is free to download. A free tier ("Ghar" or equivalent) provides limited access. Paid subscription tiers provide additional features.

6.2 Current subscription plans

Subscription plans, features, and pricing are as displayed in the App and subject to change. As of the Effective Date:

All subscriptions are billed and managed through Apple App Store or Google Play, according to their respective billing systems. You agree to the billing terms of the platform you use.

6.4 Automatic renewal

Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. Renewal charges are processed by Apple or Google.

6.5 Cancellation

You can cancel your subscription at any time through your Apple ID or Google Account subscription settings. Cancellation takes effect at the end of the current billing period.

6.6 Refunds

Refund requests are processed through Apple App Store or Google Play per their respective refund policies. FoodHandi does not process refunds directly.

6.7 Price changes

We may change subscription prices with at least 30 days' notice. Continued use of the paid features after a price change constitutes acceptance of the new pricing.

7. AI Chef Feature

FoodHandi includes an AI-powered chat feature ("AI Chef" or "Chef Kumhro") that provides food-related information, recipe suggestions, and meal assistance.

FoodHandi displays nutritional information (calories, protein, carbohydrates, fats, fiber, micronutrients) for meals, ingredients, and recipes. This information is:

9. Intellectual Property

9.1 Our IP

All content, features, and functionality of the Services (excluding User Content) — including but not limited to text, graphics, logos, icons, images, audio, code, design, trademarks, and compilations thereof — are the exclusive property of FoodHandi or its licensors and are protected by applicable intellectual property laws.

9.2 Trademarks

"FoodHandi" and any associated logos are trademarks of the Developer. You may not use them without our prior written permission.

9.3 User-submitted ideas

If you submit feedback, suggestions, or ideas, we may use them without obligation to compensate you, attribute the source, or keep them confidential.

10. Disclaimers

10.1 Service provided "as is"

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

THE SERVICES ARE NOT INTENDED TO PROVIDE MEDICAL, NUTRITIONAL, DIETARY, OR HEALTH ADVICE. NUTRITIONAL AND MEAL INFORMATION IS FOR GENERAL INFORMATION ONLY AND SHOULD NOT BE USED AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE. ALWAYS CONSULT A QUALIFIED DOCTOR OR HEALTHCARE PROVIDER FOR HEALTH-RELATED DECISIONS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOODHANDI AND ITS OPERATOR WILL NOT BE LIABLE FOR:
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR AUD 100, WHICHEVER IS GREATER.

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we were advised of the possibility of such damages.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law (for example, the Australian Consumer Law).

You agree to indemnify, defend, and hold harmless FoodHandi, the Developer, and their agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

13.1 Termination by you

You may terminate your account at any time by deleting it via Profile → Settings → Data & Privacy → Delete Account. Termination does not entitle you to a refund for unused subscription periods (subscription refunds are handled by Apple/Google per their policies).

13.2 Termination by us

We may suspend or terminate your account if:

Upon termination, your license to use the Services ends. Your User Content is deleted within 30 days except as required by law.

13.3 Survival

Sections that by their nature should survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) remain in effect after termination.

14. Governing Law and Jurisdiction

This Agreement is governed by the laws of Australia, without regard to conflict of law principles. For users residing in other jurisdictions, additional local consumer protection laws may apply, including:

15. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be effective upon posting at the hosted URL (accessible via Profile → Legal section in the App).

For material changes, we will notify registered users via email or in-app notification at least 30 days before the changes take effect.

Continued use of the Services after the effective date of updates constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Services and may delete your account.

16. General Provisions

16.1 Entire agreement

These Terms, along with the Privacy Policy, constitute the entire agreement between you and FoodHandi regarding the Services.

16.2 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 No waiver

Our failure to enforce any provision does not waive our right to enforce it later.

16.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights to any successor or affiliate.

16.5 Language

These Terms are drafted in English. Any translation is provided for convenience only. In case of conflict, the English version prevails.
